Terms of Service v0.1

1. Definitions

Software: the Arxyne CLI and engine, distributed as a PyPI wheel under BSL 1.1.

License Server: Arxyne-managed service at license.arxyne.com (future) or self-hosted instance deployed by the customer behind their firewall.

Customer Data: any data processed locally by the Software (case configs, simulation inputs, results, USD product definitions).

License Key: credential issued to validate paid feature access.

2. License

  • Free tier: non-production use of the Software is permitted under the Business Source License 1.1
  • Paid features (multi-physics, sweeps, compliance reports) require a license key validated by a license server
  • Enterprise customers may deploy a license server on their own infrastructure
  • License keys are non-transferable between organisations

3. Permitted Use

  • Use the Software for lawful engineering simulation, design, and analysis
  • Integrate the CLI into internal workflows and toolchains
  • Use outputs (simulation results, analyses) for any lawful commercial purpose
  • User owns their outputs and all input data

4. Prohibited Use

  • Reverse engineering, decompiling, or disassembling compiled native extensions
  • Using the Software to build a competing product or service
  • Reselling, sublicensing, or redistributing the Software under terms different from BSL 1.1
  • Circumventing license validation or feature gating
  • Sharing license keys across organisations
  • Automated scraping or extraction of the Software's compiled logic

5. Intellectual Property

  • All IP in the Software (code, algorithms, processes) remains Arxyne's property
  • Business-logic modules are distributed as compiled native extensions
  • Users retain full ownership of input data and output results
  • No license to Arxyne's IP beyond the right to use the Software under BSL
  • Arxyne does not claim rights over Customer Data
  • Nine UK patents pending (PA-1 through PA-9)

6. No Cloud Processing

  • The Software runs entirely on the user's machine
  • Arxyne does not receive, store, or process Customer Data
  • No data leaves the user's environment unless the user explicitly configures a remote solver (user-managed infrastructure)
  • The license server (when deployed) only validates feature access — no simulation data is transmitted

7. Disclaimers & Limitations

  • Software provided "as is" — no warranty of fitness for purpose
  • Arxyne not liable for simulation accuracy or engineering decisions made based on Software outputs
  • Users responsible for solver licensing (OpenFOAM GPL, DoMINO NGC, etc.)
  • Arxyne not liable for third-party solver performance or accuracy
  • Limitation of liability to license fees paid (when applicable)

8. Termination

  • Arxyne may terminate a license for breach of these terms
  • Upon termination, all paid features are deactivated
  • Free-tier non-production use continues under BSL unless the license itself is terminated due to violation of BSL terms
